2. Description of Service

Filmvision AI is a software-as-a-service platform that provides AI-powered filmmaking and storytelling tools. The Service includes:

• AI-generated images and videos for visual storytelling
• Character and location creation tools
• Storyboard and scene visualization
• Project management for creative workflows
• Third-party AI model integrations

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription Plans and Credits

The Service operates on a subscription and credit-based model:

• Free accounts receive a one-time credit allocation for trial purposes
• Paid subscriptions provide monthly credit allocations
• Credits are consumed when using AI generation features
• Unused credits from monthly allocations do not roll over to the next billing period
• Subscription fees are billed in advance and are non-refundable
• We reserve the right to modify pricing with 30 days notice

5. User Content

"User Content" includes screenplays, scripts, images, videos, and any other materials you upload, create, or generate using the Service.

You retain ownership of your User Content.

By using the Service, you grant Filmvision AI a non-exclusive, worldwide license to store, process, and display your User Content solely for the purpose of providing the Service.

You represent and warrant that:

• You have all rights necessary to upload and use your content
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws or regulations

6. AI-Generated Content

The Service uses third-party AI models to generate images, videos, and other content. You acknowledge that:

• AI-generated outputs may be similar to content generated for other users
• We do not guarantee exclusivity of AI-generated content
• AI outputs may contain errors, inaccuracies, or unexpected results
• You are responsible for reviewing AI-generated content before use
• The quality and availability of AI features depend on third-party services

Subject to these Terms, you may use AI-generated content for personal and commercial purposes, unless otherwise restricted by applicable third-party AI provider terms.

7. Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Create deepfakes or non-consensual imagery of real individuals
• Generate content that infringes intellectual property rights
• Produce content depicting minors in inappropriate situations
• Circumvent usage limits or manipulate the credit system
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization

8. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by Filmvision AI and protected by intellectual property laws.

These Terms do not grant you any rights to our trademarks, brands, or logos. You may not use our branding without prior written consent.

9. Third-Party Services

The Service integrates with third-party AI providers and other services. These integrations are subject to their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice when possible.

11. Limitation of Liability

To the maximum extent permitted by law, Filmvision AI and its affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from use of AI-generated content
• Issues caused by third-party services or internet connectivity

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to indemnify and hold harmless Filmvision AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

You may cancel your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms or for any other reason with notice.

Upon termination, your right to use the Service ends immediately. We may delete your User Content after a reasonable retention period.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which Filmvision AI operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
